Is Kratom legal in my state? It's a question we get asked again and again and the short answer is, yes it is in some but not in others. In 2025, Kratom is legal in the US, but not in all areas.
The Southeast Asian tree’s leaves contain a range of alkaloids, including mitragynine and 7-hydroxymitragynine. While these alkaloids may produce psychoactive effects when taken in large quantities they are also believed to deliver a range of wellness benefits when consumed in optimal doses. Effects are reputed to range from pain relief and sleep support, to improved mood and sociability - this is where Kratom's appeal lies. It's a versatile herb which may address a range of wellbeing issues and provide an alternative to over-the-counter medications.
Many people support its use, while some have concerns over its safety. Because the science and research around Kratom is still in its infancy this divide has led to somewhat confusing laws regarding its legality and several countries, states and cities around the world have banned or restricted its sale and use.
The good news is, Kratom is widely available across the US. Only five states (Wisconsin, Indiana, Alabama, Arkansas, Rhode Island) have banned Kratom outright but the laws are nuanced and many more local bans and restrictions exist across the country.

Is Kratom legal in my state?
Federal and state law
Kratom is legal at the federal level. The Drug Enforcement Administration (DEA) and Food & Drug Administration (FDA) have attempted to ban it. Facing opposition from supporters of the herbal leaf, their efforts to ban it have been unsuccessful to date.
Federal law dictates that each state may decide whether to prohibit or allow Kratom. Individual counties can also present their own rules and regulations. Different jurisdictions have unique legislation regarding the herb’s sale, possession and use.
American Kratom Association
The American Kratom Association (AKA) is the primary driving force behind Kratom advocacy. It introduced the Kratom Consumer Protection Act (KCPA) which some states have adopted. The legislation ensures safe and regulated access to Mitragyna speciosa products.
The KCPA aims to combat adulterated, dangerous Kratom products that have raised concerns. It requires vendors to provide informative labels on all stocks. This measure also helps sellers comply with FDA parameters.

Is Kratom legal in Alabama?
KRATOM IS ILLEGAL IN ALABAMA.
The state passed Senate Bill 226 in 2016. It classified mitragynine and hydroxymitragynine as Schedule I controlled substances. You may not use, possess, buy or sell any products containing these alkaloids. Possessing kratom in Alabama is a Class C felony. Offenders could receive a maximum fine of $15,000 and 1–10 years’ imprisonment. A second offense risks a $30,000 maximum fine and 2–20 years in jail.
Is Kratom legal in Alaska?
KRATOM IS LEGAL AND UNREGULATED IN ALASKA.
The herb has no restrictions, so we advise using your discretion when buying it. There have been no indications of Alaska introducing regulations or Kratom laws. The AKA hopes to bring the KCPA into the state to protect local users.
Is Kratom legal in Arizona?
KRATOM IS LEGAL IN ARIZONA, WHICH PASSED THE KCPA IN 2019.
It regulates all Mitragyna speciosa products, prohibiting sales to minors under 18. Selling or exposing Kratom to underage individuals is a class two misdemeanor. Offenders face fines of $750 and up to four months’ jail time. The Arizona KCPA also requires sellers to label all Kratom products comprehensively.
Is Kratom legal in Arkansas?
KRATOM HAS BEEN ILLEGAL IN ARKANSAS SINCE OCTOBER 2015.
Possessing under two grams is a Class D felony, while having 2–28 grams is a Class C felony. Any amount over 28 grams is a Class B felony and could result in a $15,000 maximum fine or up to 20 years’ imprisonment. The AKA has encouraged Arkansas to adopt the KCPA, but advancements have yet to occur.
Is Kratom legal in California?
KRATOM IS MOSTLY LEGAL IN CALIFORNIA BUT INTRA-STATE BANS EXIST.
The cities of San Diego and Oceanside outlawed Kratom in 2016. Possessing it there results in a misdemeanor charge, with a $1,000 fine and a maximum of six months’ jail time. You may legally use, buy and possess Kratom in the rest of California. Adoption of the KCPA is under consideration but, as yet, undecided.
Is Kratom legal in Colorado?
KRATOM IS LEGAL AND REGULATED IN COLORADO BUT LOCAL RESTRICTIONS EXIST.
The towns of Monument, Greenwood Village and Parker banned Kratom in 2019. Castle Rock limits Kratom products to over 18s only. All other Colorado areas adopted the KCPA in 2024. You may legally use, buy, possess and sell Kratom products as long as you are over the age of 21.
UPDATE: SB72, considered dead in the water, was revived by a rare 'super motion' in May 2025. If passed, the bill will introduce further strict Kratom regulations across the state.
UPDATE 2: SB74, to be known as the Daniel Bregger Act, was signed off by the state governor at the end of May 2025. This act builds upon the first KCPA (adopted in 2022) and will introduce a raft of stricter restrictions for Coloradans to grapple with.
Is Kratom legal in Connecticut?
KRATOM IS LEGAL AND UNREGULATED IN CONNECTICUT.
You may buy it at head shops, vape stores and specialty vendors. The state will hopefully pass the KCPA soon.
Is Kratom legal in Delaware?
DELAWARE HAS NO RESTRICTIONS ON KRATOM.
You may buy and use it freely, but we advise getting it from a reputable source that sells safe products. There are no pending bills for regulating the herb. The AKA encourages the state to introduce the KCPA.
Is Kratom legal in Florida?
KRATOM IS LEGAL IN FLORIDA, EXCEPT FOR SARASOTA COUNTY.
The state adopted the KCPA in 2023, allowing the regulated use and sale of Kratom. Sarasota County banned Kratom in 2014 and likely won’t reverse the ban unless the FDA approves it.
Is Kratom legal in Georgia?
KRATOM IN GEORGIA IS LEGAL, WITH THE KCPA BEING INTRODUCED IN JANUARY 2025.
The passing of House Bill 181 in January protects vendors and buyers of Kratom in Georgia. Only residents over 21 can buy the herb legally across the state. Vendors must label Kratom products with the alkaloid content and ingredients. They must also display disclaimers, manufacturer information and proper use instructions. Failure to do so can result in a misdemeanor charge, a $1,000 fine or one year in jail.
Is Kratom legal in Hawaii?
KRATOM IS LEGAL AND UNREGULATED IN HAWAII.
No pending laws or KCPA proposals exist, but the state has considered regulating the herb.
Is Kratom legal in Idaho?
KRATOM IS LEGAL AND UNREGULATED IN IDAHO.
There have been attempts to introduce the Kratom Consumer Protection Act (KCPA) to Idaho but, as yet, the bill hasn't been passed into law.
Is Kratom legal in Illinois?
KRATOM IS LEGAL IN ILLINOIS, WITH EXCEPTIONS.

The state is considering introducing the KCPA, but no advancements have occurred yet other than the minium age for use. You may use Kratom reely in the rest of the state if you’re over 18. Selling to minors is a Class B misdemeanor, resulting in a maximum fine of $500.
UPDATE: in May 2025, Marion and Herrin City councils voted to make Kratom illegal, following testimonies from individuals impacted negatively by Kratom including a wife whose husband died after taking Kratom and from first responders who refer to it as 'gas station heroin.'
Is Kratom legal in Indiana?
KRATOM IS BANNED IN INDIANA.
Lawmakers classify it as a Schedule I controlled substance like cocaine and heroin; it has been banned here since 2014. Republicans introduced the Indiana House Bill 1500 in January 2023. It passed House on February 21st, 2023, so locals hope the Senate will also pass and sign it into law. Kratom will become legal statewide if it takes effect.
Is Kratom legal in Iowa?
KRATOM IS LEGAL TO BUY, SELL AND POSSESS IN IOWA.

Is Kratom legal in Kansas?
KRATOM IS LEGAL AND UNREGULATED IN KANSAS.
A 2018 bill attempted to criminalize the herb, but it was unsuccessful. The state considered House Bill 2084 to introduce the KCPA but this failed to pass.
Is Kratom legal in Kentucky?
KRATOM IS REGULATED AND IT IS LEGAL TO BUY, USE AND SELL IN KENTUCKY.
Kentucky adopted the KCPA in 2024 with a raft of restrictions designed to protect consumers and sellers, including a minimum age and strict product packaging guidelines.
Is Kratom legal in Louisiana?
KRATOM IS LEGAL IN LOUISIANA WITH SOME LOCAL RESTRICTIONS.
Kratom is banned in the following towns:

- Ouachita Parish
- LaSalle Parish
- Rapides
- Zachary City
- Walker
- Concordia Parish
- Tangipahoa Parish

Introduction of the KCPA is being considered, with a latest round of amendments having very recently been made to HB253 (04/16/25). However, there is a competing bill (SB154) which aims to ban Kratom as a Schedule 1 Substance also in the works.
UPDATE: SB154 which proposes to ban Kratom in Louisiana moved forward on 04/29/25 after the Senate Judiciary Committee advanced the bill that would criminalize it.
UPDATE 2: SB154 was backed unanimously 87-6 at the end of May 2025 and is due to be signed into law by the state governor imminently - despite strong advocate resistance. If signed off, Kratom will be banned in Louisiana from August 2025.
Is Kratom legal in Maine?
KRATOM IS LEGAL AND UNREGULATED IN MAINE.
Maine lawmakers tried to classify the dominant alkaloid in Kratom - Mitragynine - as a controlled substance in 2017 but were unsuccessful. Adoption of the KCPA statewide is under consideration instead.
Is Kratom legal in Maryland?
KRATOM IS LEGAL AND REGULATED IN MARYLAND.
The KCPA has been in place since October 2024 with restrictions on buyers and sellers. As well as a minimum age of 21 for buyers, there are a raft of strict guidelines that manufacturers and vendors must follow, including marketing and packaging regulations.
Is Kratom legal in Massachusetts?
KRATOM IS LEGAL AND UNREGULATED IN MASSACHUSETTS.
The House of Representatives attempted to ban it but failed, while adoption of the KCPA is under consideration for the state with House Bill 3762.
Is Kratom legal in Michigan?
KRATOM IS LEGAL AND UNREGULATED IN MICHIGAN.
The herbal leaf is unregulated but a KCPA bill is awaiting approval.
Is Kratom legal in Minnesota?
KRATOM IS LEGAL AND MAINLY UNREGULATED IN MINNESOTA.
The state made using it illegal for individuals under 18 to buy Kratom products. Vendors caught making sales to minors will receive a gross misdemeanor charge. Some representatives have proposed the KCPA but it hasn’t taken effect yet.

UPDATE: Mississippi adopted the KCPA in April 2025 (House Bill 1077) and it will become law in July of this year. Buyers will need to be over the age of 21 and synthetic Kratom products or products with high levels of 7-OH will be banned.
Is Kratom legal in Missouri?
KRATOM IS LEGAL IN MISSOURI BUT REGULATION IS IMMINENT.
While it is currently legal to buy, sell, possess and use Kratom across the state, KCPA legislation is in progress that will place a minimum age limit on buyers and also place restrictions of ingredients in Kratom products.
Is Kratom legal in Montana?
KRATOM IS LEGAL IN MONTANA WITH NO REGULATION.
There is no prospect of a KCPA bill but the American Kratom Association (AKA) encourages the state to adopt one.
Is Kratom legal in Nebraska?
KRATOM IS LEGAL AND UNREGULATED IN NEBRASKA.
The legal status of Kratom in Nebraska is the subject of fierce debate currently, with opposing bills - one aiming to outlaw the leaf, the other proposing the introduction of the KCPA - both on the table. While a motion has been passed to classify Kratom as a Schedule 1 Controlled Substance, this has faced opposition with a push for the KCPA to be adopted instead. You can read more here.
Is Kratom legal in Nevada?
KRATOM IS LEGAL AND REGULATED IN NEVADA.
Nevada introduced the KCPA in 2016 and adopted it in 2019. Citizens over 18 may freely use and buy the herb from licensed manufacturers. Contaminated Kratom products and underage sales are illegal. Vendors must place clear labels with usage and ingredient information on all items.
Is Kratom legal in New Hampshire?
KRATOM IS LEGAL IN NEW HAMPSHIRE, WITH ONE EXCEPTION.
Kratom is banned in Franklin City, but you may use, possess and buy it lawfully in the rest of the state if you’re over 18. The intra-state ban could change if lawmakers pass the KCPA, which has been in review since 2022.
Is Kratom legal in New Jersey?
KRATOM IS LEGAL AND UNREGULATED IN NEW JERSEY.
Several bills have attempted to criminalize Kratom but so far they’ve been unsuccessful. The state is also considering introducing the KCPA.
Is Kratom legal in New Mexico?
KRATOM IS LEGAL AND UNREGULATED IN NEW MEXICO.
No regulations exist, and there have been no attempts to ban it or pass the KCPA.
Is Kratom legal in New York?
KRATOM IS LEGAL IN NEW YORK AND WITHOUT REGULATION.
The state has tried to make the herb illegal several times. Overwhelming support from advocates rendered the proposed bills unsuccessful. Senate Bill S4552 is in the works to prohibit the sale of Kratom to anyone under the age of 21.
Is Kratom legal in North Carolina?
KRATOM IS LEGAL AND MOSTLY UNREGULATED (AGE RESTRICTION).
Anyone over the age of 18 may legally buy, sell or possess Kratom in North Carolina.
Is Kratom legal in North Dakota?
KRATOM IS CURRENTLY LEGAL AND UNREGULATED BUT CHANGE IS IMMINENT.
The state’s legislators and lobbyists are considering introducing the KCPA. No advancements have happened yet. Recently, a move to reclassify Kratom as a Scehdule 1 Substance in North Dakota was thwarted 77-15 in a vote. Read more here.
Is Kratom legal in Ohio?
KRATOM IN OHIO IS LEGAL BUT ONLY IN POWDER FORM.
The state does not allow Kratom to be sold 'for human consumption' and as such only powder is legal. Anything else, e.g. gummies, capsules or edibles, are banned in accordance with the FDA ruling.
Is Kratom legal in Oklahoma?
KRATOM IS LEGAL AND REGULATED IN OKLAHOMA.
Oklahoma passed House Bill 1784 in 2021, introducing the KCPA to protect citizens. The KCPA was then adopted statewide in 2024 making Kratom legal for residents over 18. As with all AKA acts safety regulations exist, including requirements for sellers to stock contaminant-free products. They must also provide item dates and lab test results.
Is Kratom legal in Oregon?
KRATOM IS LEGAL AND REGULATED IN OREGON, WITH ONE EXCEPTION.
The state introduced the KCPA in 2022, allowing citizens over 21 to buy, use and possess Kratom. Vendors must register with the Department of Revenue to sell it. However, Kratom is banned in Hines City.
Is Kratom legal Pennsylvania?

A KCPA bill was passed in 2022 but this only restricts the age you can buy Kratom to over 18 years old.

Is Kratom legal in South Carolina?
KRATOM IS LEGAL AND REGULATED IN SOUTH CAROLINA - KCPA ADOPTED MAY 2025!
The state is considering introducing their version of the KCPA (SB 5043) which will regulate the minimum age someone can buy Kratom to 21 and also enforce stricter labeling guidelines.
UPDATE: in May 2025, the governor of South Carolina signed the Kratom Consumer Protection Act, introducing a minimum age (21) for sales and strict labeling guidelines for Kratom producers. Great news from a state that, not so long ago, was considering criminalizing Kratom!
Is Kratom legal in South Dakota?
KRATOM IS LEGAL AND REGULATED IN SOUTH DAKOTA.
With the KCPA adopted in January 2025, South Dakota now regulates the purchase and sale of Kratom. Limits on minimum age (21), alkaloid content and serving size are just a few of the restrictions included in this act.
Is Kratom legal in Tennessee?
KRATOM IS LEGAL IN TENNESSEE IF YOU ARE OLDER THAN 21.
Natural Kratom and associated products are legal, however synthetic versions of mitragynine or hydroxymitragynine are banned.
Is Kratom legal in Texas?
THE USE, SALE AND POSSESSION OF KRATOM IS LEGAL AND REGULATED IN TEXAS.
The state passed the KCPA in 2023, making unlabeled and adulterated products unlawful. It also prohibits individuals under 18 from buying the herbal leaf.
UPDATE: In April, State Bill 1868 proposed to add Kratom to its Controlled Substances List and ban Kratom statewide (with a view to enforcement from September 2025). Watch this space as developments will happen fast.
Is Kratom legal in Utah?
THE FIRST STATE TO ADOPT THE KCPA, KRATOM IS LEGAL AND REGULATED IN UTAH.
Utah passed the SB 58 Kratom Consumer Protection Act in 2019. Buyers must be over 18 and vendors must label products with lab results, alkaloid concentration and manufacturer information. Manufacturers must also register with the local Department of Agriculture.
Is Kratom legal in Vermont?
KRATOM IS LEGAL IN VERMONT IF YOU ARE OVER 21.
The Vermont Department of Health removed Kratom as a Schedule I controlled substance in 2023. The state is considering regulation with the KCPA.
Is Kratom legal in Virginia?
KRATOM IS LEGAL AND REGULATED BY KCPA IN VIRGINIA.
The bill has been in effect since July 2023. The SB 1108 Virginia Consumer Protection Act allows individuals of 21 and older to use Kratom freely. All products must have labels that list the ingredients.
Is Kratom legal in Washington?
KRATOM IS LEGAL IN WASHINGTON STATE.
No regulations exist but Senator Honeyford wants to pass the KCPA. There have been no advancements since 2022, but citizens remain hopeful.
Is Kratom legal in West Virginia?
KRATOM IS LEGAL AND REGULATED IN WEST VIRGINIA.
West Virguinia has followed the KCPA since 2023 with the recent addition of annual registration for Kratom vendors in 2025. Buyers must be over 21 and vendors must label their products as per state guidelines.
Is Kratom legal in Wisconsin?
KRATOM IS ILLEGAL IN WISCONSIN.
Possessing it is a misdemeanor and creating or distributing it is a felony. Carrying mitragynine could result in 3.5 years in jail or a maximum fine of $10,000. Distributors and manufacturers may face up to six years in jail. There are talks to reverse the Kratom ban in Wisconsin and introduce the KCPA so watch this space.
Is Kratom legal in Wyoming?
KRATOM IS LEGAL AND UNREGULATED IN WYOMING.
To date, the state hasn’t experienced any attempts to ban or regulate Kratom's use. The AKA has encouraged all areas to adopt the KCPA.
Why is Kratom banned in some states?
Kratom has faced many controversies due to conflicting reports on its safety. Some states have banned it in response to fears over its usage. Others are waiting for the FDA and DEA to approve the herbal leaf or place it on the list of controlled substances.
The DEA called Kratom a 'drug of concern' in June 2020. The FDA has released claims that the herbal leaf has no potential medicinal benefits. Advocates of Kratom fiercely dispute this claim but the scientific evidence, although growing, is still playing catchup.
Few clinical studies are available on Kratom effects, whether positive or harmful. A 2022 study showed mitragynine doesn’t produce life-threatening or respiratory depressant effects. Despite results like this, experts still express concerns over the herbal leaf’s alkaloids.
Reports of adverse effects from mitragynine and 7-hydroxymitragynine include:
- Dry mouth
- Constipation
- Depression
- Sweating
- Muscle pain
- Nausea and vomiting
- Liver damage
- Seizures
- Delusions
Most Kratom users don’t experience any of these effects. Some experts suspect other substances caused these symptoms in the reported cases. The KCPA and regulations are vital for ensuring safe, pure, additive-free Kratom products.
